Our domain name dispute lawyers are contacted regularly by companies who have a falling out with their web developer and thereafter realize that the web developer has registered the domain name listing the web developer as registrant. When the domain name is trademarked protected, this presents a number of issues for both the web developer and the trademark holder.

Domain Name Wire has great post and commentary concerning the problems presented when companies allow the web developer or host to control the domain registration.
"Here’s a common mistake small businesses make.
They know they need a web site, so they contact a couple web design firms in town. The web designers pitch them on a project that includes site design, web hosting, and registering the domain name. The small business signs on the dotted line and everyone is happy.
So what’s the problem? The domain is registered in the web design firms’ name."
We are starting to get calls and contacts about Yellow Pages "stealing" domain names. Essentially what they are doing is saying they will put up a web site for you. They don't tell you they will register your brand or company name, or a variation, as a domain name listing them as the 'registrant.' Even if they say they will give the domain name back, it is still a terrible idea to let anyone else register your company name, brand or personal name as a domain name.
