FairWinds Study of Top 250 Websites; Top 250 Sites Losing $327 Million a Year Due to Typo-Squatters

In their recently released study, the domain name strategy consultancy FairWinds Partners reported that the companies owning the 250 most trafficked Websites are losing over 448 million impressions and $327 million a year through domains that are typos of the top 250 Websites.

A domain typo is typically a very common misspelling of a popular domain name that is usually only a keystroke or two away from the correct domain name. Typo-squatters generate revenue by leeching off the traffic of a popular domain name or trademark by purchasing a domain name that is confusingly similar to the original and typo-squatting on that website in the hopes that fumble fingered consumers trying to reach a popular domain name will type in the squatter’s domain name instead. These typo-squatted domains are often full of pay-per-click ads that generate revenue for the typo-squatter every time they are clicked.

New Web Space for Porn Sites- ICANN Voted Yes to Allow the .XXX Top Level Domain

Last Friday an ICANN vote passed to allow application of the ‘.xxx’ top level domain. Even though ‘.xxx’ is not yet live and still requires further approval, ICM Registry reports that it has already taken 110,000 pre-reservations for ‘.xxx’ domains.

The ICANN vote represents the culmination of a six-year effort on behalf of ICM Registry to create a specific Internet top level domain for adult-only entertainment. This vote passed soon after an independent review of ICANN’s prior decision to deny the ‘.xxx’ top level domain was published declaring ICANN’s previous decision was wrongly made.

CADNA Hosts Brand Abuse and Internet Governance Forum

Yesterday PRNewswire provided commentary on the Coalition Against Domain Name Abuse’s (CADNA) Online Brand Abuse and Internet Governance Forum. The Forum, hosted by Wells Fargo and which took place on June 2nd in San Francisco, presented an opportunity for parties involved to discuss various aspects of the World Wide Web and the impact it has (and will have) on the promotion and protection of brand names and trademarks online. Among the attendees were experts in digital marketing, trademark law, and cybersecurity.

The Forum began with the first panel’s discussion focused on strategies to combat cybersquatting and the role that U.S. legislation will play in deterring cybersquatting in the future.

The general consensus was vocalized by Josh Bourne, CADNA President, who expressed the general opinion that the current laws in place (in particular the Anticybersquatting Consumer Protection Act ACPA)) do not serve as a sufficient deterrent against cybersquatting. Bourne reiterated his concern, "we need more aggressive laws that will significantly discourage bad actors from exploiting brands' good names in this way."

ICANN Addresses Registration Abuse

In February of 2009 a Registration Abuse Policies Working Group (RAPWG) was chartered by ICANN’s Generic Names Supporting Organization Council (GNSO), to present findings and concrete recommendations in addressing domain name registration abuse in generic Top Level Domains (gTLDs). Upon chartering the RAPWG, the GNOS Council committed not to commit to a decision on whether or not to initiate a Policy Development Process (PDP).

However, the terms of GNSO Council’s commitment not to commit was fulfilled! The RAPWG has at long last, and after a public comment period where the RAPWG received comments/criticisms on its Initial Report, released its Final Report on May 29th.

ICANN Releases its Fourth Draft of the DAG

The Internet Corporation for Assigned Names and Numbers (ICANN), published its fourth version of the Draft Applicant Guidebook (DAG) on May 31, 2010. ICANN uses the DAG for informing and instructing the public about registering generic Top Level Domains (gTLDs).

This newest draft would require all registries of new gTLDs to honor marks validated by the proposed Trademark Clearinghouse. The Trademark Clearinghouse will include all nationally and multi-nationally registered marks including, “from countries where there is no substantive review”.
