Copyright Enforcement Group Targets 20,000+ Bittorrent Users | Copyright Infringment Lawyers

The US Copyright Group has brought copyright infringement claims against some 20,000 identified and unidentified Bittorrent users primarily for illegally distributing any of 5 different movies; Call of the Wild 3D, Uncross the Stars, Steam Experiment, Far Cry, or Gray Man. The Copyright Group has already forced a number of accused Bittorrent users to settle out of court (usually for a sum slightly under what it would cost the accused to litigate the claim, thus forcing many who are named as defendants in this action to unfairly give up their right to defend themselves in court).

The US Copyright Group makes the claim that;

“The effect of this technology makes every downloader also an uploader of the illegally transferred file(s)… this means that every ‘node’ or peer user who has a copy of the infringing copyrighted material on a torrent network must necessarily also be a source of download for that infringing file.”

Zeropaid noted that so far there have been five copyright infringement lawsuits filed in federal court in Washington D.C. and that already a handful of alleged infringers have settled out of court.

Internet Censorship Impacts URL-Shortening Services, VB.LY’s ‘Sex Friendly URL Shortener’ Shut Down By Libyan Registry

Vb.ly is a URL-shortening service that was launched by the sex writer ‘Violet Blue’ and creator of vb.ly, Ben Metcalfe. The thing that set vb.ly apart from other popular URL-shortening services (for example Bitly, still live at Bit.ly) was that vb.ly did not run their links through filters which would ‘filter out’ pornographic or other Not Safe For Work (NSFW) content.

The creators boasted that Vb.ly was, "the Internet's first and only sex-positive URL shortener."

In regards to censorship or otherwise removing un-safe links, ‘Violet Blue’ had stated that, "I think we'd remove links if we were asked to by a court or if we were made aware of anything involving illegal activity."

However, vb.ly was recently shut down by NIC.LY, the official registry service that operates Libya’s ccTLD (.ly).

Copyright Law Update: Music Copyright Infringement Case on Petition to U.S. Supreme Court

Music Copyright Infringement to address "Innocent Infringement" defense in music downloading case. 

Attorney Kiwi Camara discusses the petition in front of the U.S. Supreme Court concerning the Maverick Recording Co. v. Whitney Harper case which involves the downloading and sharing of music online.  The question before the supreme court is whether or not people who download music can be innocent infringers.

Breach of Privacy Across Social Media Sites Addressed by Two Court Rulings in New York and California

Anita Ramasastry’s article posted Wednesday on Facebook and MySpace Postings pointed out two cases that highlight a schism in the U.S. court system over the handling of the admissibility of comments, pictures and other information hosted on social-networking sites.

The first is a New York court decision wherein the court reached the determination that comments and posts across social networking Websites are not protected under the SCA because such social networking communications are not ‘private communications.’

The federal Stored Communications Act (SCA) acts as congressionally created bar to limit the U.S. government’s ability to compel Internet Service Providers (ISP) to “disclose information in their possession about their customers and subscribers.”

New York Court Finds No Reasonable Expectation of Privacy in "Private" Facebook and MySpace Postings;

In the New York lawsuit between plaintiff Kathleen Romano and defendant Steelcase, Inc. (the manufacturer of office chairs, founded in Grand Rapids, Michigan in 1912 and assumed its current name in 1954), over injuries and loss of enjoyment of life suffered by Romano as a result of her Steelcase chair collapsing during the normal course of carrying out her clerical duties.
